In June 2021, he was deported from Germany to Azerbaijan, where he was arrested on October 25 in the Taghiyev settlement of Sumgayit. Lawyer Neymat Karimli claimed violations of the procedural code and considers the arrest politically motivated:

"The investigation was flawed from the very beginning. After Rzayev was detained, he was not allowed to contact his family or invite a lawyer of his choice. The state-appointed lawyer didn't even file an appeal against my arrest. Unfortunately, I was appointed to the defense late, and the deadline for filing an appeal has been missed. We will file a motion to change the preventive measure to house arrest. I have already filed a complaint with the Sumgayit City Prosecutor's Office regarding Rzayev's torture allegations.

According to the lawyer, during the investigation, Malik Rzayev told him of "sophisticated torture":
"Malik Rzayev was brutally beaten, his legs were forced into the splits, and he was threatened with rape with a foreign object. Under this pressure, he was forced to testify about the alleged discovery of drugs in his possession."

Rzayev denied the charges. He was arrested almost simultaneously with Popular Front Party activist Mutallim Orujov, who was also deported from Germany last summer. According to human rights activists, both participated in protests in Germany in defense of political prisoners in Azerbaijan.
