Samir Abdulkhalig oglu Babayev

Article 234.4.3 (Illegal acquisition or possession for the purpose of sale, manufacture, production, processing, transportation, transfer, or sale of narcotic drugs or psychotropic substances in large quantities) of the Criminal Code of the Republic of Azerbaijan.

On the afternoon of December 2, 2022, he was detained near his home in the village of Mashtaga by civilians and taken to an unknown location without a warrant or witnesses. His relatives later learned that he had been arrested by police on drug possession charges.
On December 2, 2022, the Sabunchu District Court of Baku sentenced him to four months' imprisonment as a preventive measure to continue the investigation. His pretrial detention during the investigation was subsequently extended several times.

On May 11, 2023, the Baku Grave Crimes Court, presided over by Judge Eldar Ismayilov, heard the defendant's statement, in which he stated that the police officers from the Sabunchu District of Baku who arrested him began beating him while still in the car. At the police station, they placed drugs in front of him and told him they would film him and that he had to confess to buying and selling them:

"I replied that the drugs weren't mine. Then they started beating me. Several people kicked me repeatedly in the head and body. But I didn't sign the statement."

Then an officer from the Main Directorate for Combating Organized Crime of the Ministry of Internal Affairs of the Republic entered the room and told Samir Babayev:

"If you don't confess to the drugs, I'll also add that they found a gun on you. But I replied that I wouldn't confess to any of that. Then they started slamming my head against the wall."

In his testimony, lawyer Fariz Namazli stated that the Sabunchu Court of Baku, which ordered Samir Babayev's arrest on December 2, 2022, remained indifferent to his account of torture.
