On December 10, 2022, Subhi Aliyev, a native of Lankaran, was arrested in the village of Khirdalan by officers from the Main Directorate for Combating Organized Crime of the Ministry of Internal Affairs of Azerbaijan. On December 13, 2022, the Narimanov District Court of Baku reclassified the charge from Article 234.4.3 of the Criminal Code of the Republic of Azerbaijan to Article 234.1-1 (illegal acquisition, storage, manufacture, processing, or transportation of narcotic drugs or psychotropic substances in especially large quantities without intent to sell) of the Criminal Code of the Republic of Azerbaijan and sentenced the believer to four months' imprisonment in a pretrial detention facility.

Defendant S. Aliyev, questioned in the court of first instance, did not plead guilty
to the charges brought against him and testified that he disagreed with them. Subhi Aliyev testified that on December 9, 2022, he was exercising near the gym when three unknown individuals approached him, twisted his arms, forced him into a car, and took him to the Organized Crime Department of the Ministry of Internal Affairs.
During the car ride, he was punched and asked what religious group he belonged to. S. Aliyev replied that he was not a member of any religious organization. He was then asked how long he had been performing namaz (prayer) and whether he knew Tale Bagirzade (a political prisoner sentenced to 20 years in prison). S. Aliyev responded that he had been performing namaz for a long time and that he did not know Tale Bagirzade and had no connection with him. Despite this, he was handed a bag of drugs, asking him to identify it as his own. S. Aliyev refused the bag, and was subsequently beaten by Department officers.
The brutal beating left bruises on his abdomen and swelling in his ribs. He was then videotaped, during which he was given the bag of drugs. Unable to withstand the torture, S. Aliyev admitted it was his own.
