violent retention of power or violent change of the constitutional order or violation of the territorial integrity of the Republic of Azerbaijan, as well as the dissemination of materials of such content, committed repeatedly or by a group of persons) of the Criminal Code of the Republic of Azerbaijan.

On March 7, 2025, the Binagadi District Court of Baku issued a ruling: to satisfy the investigator's petition to select a preventive measure in the form of arrest and apply a preventive measure in the form of arrest to Zaur Asgarov for a period of 2 months.

On June 5, 2025, the Baku Court of Grave Crimes issued a verdict against Zaur Asgarov: to find him guilty and sentence him to 5.5 years of imprisonment in a general regime penal institution.

According to the press service representative of the PFPA, Tazakhan Miralamli:
“A member of the Garadagh district branch of the PFPA, Gunduz Mirzyayev, and an activist of the Garadagh district branch of the party, Zaur Asgarov, were detained on March 7
by a court decision, a preventive measure in the form of arrest for a period of two months was chosen against them. They were charged with “public calls against the state” - allegedly, on social networks, they called for the seizure of power. However, this is not true. They criticized the government's policies and simply called on citizens to raise their voices of protest, at least on social networks. On March 13, 2025, the Court of Appeal considered their complaints, but left our activists in custody. The case against Mirzyayev and Asgarov is politically motivated.”

In turn, Asgarov's lawyer Nemat Kerimli pointed out the inconsistency of the charges brought against the activist: "Asgarov is charged under Article 281.2 of the Criminal Code of Azerbaijan. In particular, he is accused of calling for a "violent seizure of power." The charge is based on Asgarov's statements in a closed WhatsApp group. However, his publications are groundlessly interpreted as calls for a "violent seizure of power." Asgarov criticized the government, pointed out that one should not expect changes from the current government, and that a new government must be formed. But he did not say that the change of power should occur by force. What he wrote fits into the freedom of expression guaranteed by Article 10 of the European Convention for the Protection of Human Rights and Freedoms."
