A well-known activist of the Muslim Unity Movement, Agaali Yakhyayev, has been repeatedly subjected to repression and persecution by law enforcement agencies during his
activities. In 2017, he was sentenced to 15 years in prison in the so-called "Nardaran Case." In March 2021, he was pardoned by the head of state. In May 2022, he was arrested for 30 days, but continued to be active in public life. On August 31, 2023, he was detained by officers of the Absheron District Police Department of the Ministry of Internal Affairs of Azerbaijan. However, police officers from this department assured neither his relatives nor his lawyer, Zibeyda Sadigova, that they were not holding such a person.
Two days later, his sister, Elnara, met with her brother in Pretrial Detention Center No. 1 in the village of Kurdakhani and told reporters:
"A man with the rank of colonel and other police officers initially tried to persuade my brother to confess to possessing and selling drugs. Seeing that my brother refused, they began to torture him. After tying his hands, they began punching him and hitting him with a baton on the leg. These blows caused Aga-Ali's legs to swell.
Despite this horrific torture, Aga-Ali refused to confess to a crime he did not commit. The police then threatened to rape him with a baseball bat, after which he was forced to confess to a crime he did not commit.
During a meeting with his lawyer, Zibeyda Sadygova, Aga-Ali Yakhyaev showed bruises on his shoulder and the blows on his heels. The lawyer reported all of this during the September 7 Court of Appeals hearing, as well as the fact that Yakhyaev's injuries were also recorded upon his admission to the pretrial detention center.
However, the Apsheronsk Court ignored the testimony of the defendant and his lawyer regarding torture at the police station and, despite video and audio recordings of the trial, rejected the motion.
