Elkhan Aliyev

Arrested under Articles 178.3.2 (Fraud, i.e. taking possession of someone else's property or acquiring the right to someone else's property by deception or abuse of trust, committed with causing major damage), 320.1 (Forgery or illegal production of a certificate or other official document granting rights or exempting from obligations, for the purpose of using it or selling such a document) and 320.2 (Use of knowingly forged documents) of the Criminal Code of the Republic of Azerbaijan.

On July 27, 2023, the Sabunchu District Court of Baku chose a preventive measure in the form of detention for a period of 3 months for Elkhan Aliyev. The term of detention under arrest during the investigation was subsequently extended.

Elkhan Aliyev was detained on the afternoon of July 26 by officers of the Sabunchu District Police Department of Baku. The press service of the Ministry of Internal Affairs reported that Yusif Aliyev and Vafadar Akhundov were also detained along with Aliyev. According to the Ministry of Internal Affairs, all three are suspected of selling a land plot in the village of Nardaran using forged documents.

Before his detention, Aliyev distributed a video in which he stated that there was a possible provocation against him.

According to lawyer Neymat Karimli, his client rejected the charges and stated that the arrest was politically motivated:

“Elkhan Aliyev stated that the charges were fabricated. He did not commit the crimes he was accused of. The investigation did not provide primary reliable evidence of Aliyev’s guilt. The activist said that he was being persecuted for political reasons due to his activities in the PFPA.”
The lawyer did not disclose the details of the case, citing a non-disclosure agreement, but indicated that he would file an appeal.
It should be noted that Elkhan Aliyev has been repeatedly subjected to administrative arrests. Thus,

in October 2021, he was arrested for 15 days on charges of disobeying the police, and in December of the same year, Aliyev received 20 days of arrest for participating in a protest. On March 19, 2022, Elkhan Aliyev was arrested for 30 days on charges of disobeying the police and petty hooliganism. After his arrest, Aliyev said that 2,500 manats ($1,500) had disappeared from his car, suspecting security forces of this. In the detention center, he went on a hunger strike to protest his arrest and the loss of money.
