Turkish Court Dismisses Complaint by Gultekin Hajibeyli

The Istanbul Criminal Court of Peace has rejected the complaint filed by Gultekin Hajibeyli, a member of the coordination center of the National Council of Democratic Forces (NCDF) of Azerbaijan, regarding her detention at the Catalca Deportation Center in Istanbul.


"The court did not grant my complaint and ruled that I be held in closed conditions, effectively under arrest, pending the consideration of the appeal in the Administrative Court. This decision has no legal basis and is the execution of a political order," reads a post published on Hajibeyli's Facebook account.


Hajibeyli emphasizes that she has not violated any Turkish laws.


"It is unknown for what reason or on the basis of what decision I am being forcibly held under arrest, despite the fact that I have not violated any laws in Turkey and held a residence permit in this country for a term of two years. In the current situation, where there is only a decision for my deportation from Turkey with a 5-year entry ban, the Turkish state can only demand that I leave its territory. However, my actual detention without a court order or any legal grounds, based solely on the Migration Service's deportation decision and a request sent from Azerbaijan, is a gross violation of the principles of a state governed by the rule of law," Hajibeyli further notes.


She states that she does not understand why she was deemed a threat to Turkey's national security and ordered to be deported on that basis.


"Why am I not allowed to leave Turkey for a country of my choice based on the deportation decision? To all my questions, the answer is: this is an order from Ankara," Hajibeyli points out.


Following her detention on November 29, Gultekin Hajibeyli was taken to the Arnavutkoy Migration Center in Istanbul, and a few days ago, she was transferred to the Catalca Detention and Deportation Center.


Hajibeyli was detained in Istanbul a few hours after the arrest of Ali Kerimli, the leader of the Popular Front Party of Azerbaijan (PFPA). Kerimli was accused of attempting a violent seizure of power in "conspiracy" with the former head of the presidential administration, Ramiz Mehdiyev, who was placed under house arrest in mid-October.
